2. Zweck und Rechtsgrundlage der Datenverarbeitung

Wir verarbeiten personenbezogene Daten ausschließlich zu folgenden Zwecken:

• zur Erfüllung vertraglicher und vorvertraglicher Pflichten
• zur Einhaltung gesetzlicher, steuerlicher und berufsrechtlicher Vorgaben
• zur Buchhaltung, Fakturierung, Projektverwaltung und Auftragsabwicklung
• zur Kundenkommunikation (telefonisch, postalisch, per E-Mail)
• ggf. zur Geltendmachung und Verteidigung rechtlicher Ansprüche

Rechtsgrundlage ist Art. 6 Abs. 1 lit. a (Einwilligung), lit. b (Vertragserfüllung), lit. c (gesetzliche Verpflichtung) und lit. f (berechtigtes Interesse) DSGVO.

3. Erhebung und Kategorien personenbezogener Daten

Wir verarbeiten insbesondere:

• Stammdaten (Name, Adresse, Kontaktdaten)
• Vertragsdaten und Auftragsinformationen
• Abrechnungs- und Zahlungsdaten
• ggf. technische Planungsdaten und Grundstücksinformationen

Daten werden direkt bei den betroffenen Personen oder über Dritte im Rahmen der Auftragserfüllung erhoben.

4. Empfänger der Daten

Ihre Daten können weitergegeben werden an:

• Behörden und öffentliche Stellen im Rahmen gesetzlicher Vorschriften
• Steuerberater, Rechtsanwälte oder technische Partner zur Erfüllung unserer Aufgaben
• Banken und Zahlungsdienstleister zur Zahlungsabwicklung
• IT- und Hosting-Dienstleister im Rahmen von Auftragsverarbeitung (z. B. E-Mail-Kommunikation, Cloud-Backup)

Eine Übermittlung in Drittländer findet grundsätzlich nicht statt.

5. Speicherdauer

Personenbezogene Daten werden nur so lange gespeichert, wie es für die genannten Zwecke erforderlich ist. Steuer- und handelsrechtliche Aufbewahrungspflichten (z. B. 10 Jahre gemäß Art. 2220 ZGB/ital. Recht) bleiben unberührt.

6. Ihre Rechte

Sie haben gemäß DSGVO folgende Rechte:

• Auskunft über Ihre gespeicherten Daten (Art. 15 DSGVO)
• Berichtigung unrichtiger Daten (Art. 16 DSGVO)
• Löschung („Recht auf Vergessenwerden", Art. 17 DSGVO)
• Einschränkung der Verarbeitung (Art. 18 DSGVO)
• Widerspruch gegen Verarbeitung (Art. 21 DSGVO)
• Datenübertragbarkeit (Art. 20 DSGVO)

Zur Ausübung dieser Rechte genügt eine formlose Mitteilung an uns per Post oder E-Mail.

7. Datensicherheit

Wir setzen geeignete technische und organisatorische Maßnahmen (TOM) ein, um Ihre Daten gegen Verlust, Manipulation und unbefugten Zugriff zu schützen. Die Sicherheit unserer IT-Systeme wird regelmäßig überprüft und verbessert.

8. Keine automatisierte Entscheidungsfindung

Es findet keine automatisierte Entscheidungsfindung oder ein Profiling im Sinne von Art. 22 DSGVO statt.

I dati sono raccolti presso gli interessati o tramite terzi nel contesto degli incarichi ricevuti.

• autorità pubbliche secondo obblighi di legge
• consulenti fiscali, legali, tecnici
• banche e fornitori di servizi di pagamento
• fornitori IT e di hosting (es. comunicazioni e-mail, backup cloud)

Non è previsto alcun trasferimento verso paesi terzi.

5. Durata della conservazione

I dati personali sono conservati solo per il tempo necessario alle finalità dichiarate. Gli obblighi fiscali e contabili (es. 10 anni ai sensi dell'art. 2220 c.c.) rimangono invariati.

6. Diritti dell'interessato

Ai sensi del GDPR, avete diritto a:

• accesso ai dati (art. 15 GDPR)
• rettifica dei dati (art. 16 GDPR)
• cancellazione dei dati (art. 17 GDPR)
• limitazione del trattamento (art. 18 GDPR)

Per esercitare questi diritti, è sufficiente una comunicazione scritta per posta o e-mail.

7. Sicurezza dei dati

Applichiamo misure tecniche e organizzative adeguate per proteggere i dati da perdite, manipolazioni o accessi non autorizzati. I nostri sistemi IT sono regolarmente verificati.

8. Nessun processo decisionale automatizzato

Non vengono effettuati processi decisionali automatizzati né profilazioni.
